Affiliate Program Agreement

This Affiliate Program Agreement ("Agreement") governs participation in the affiliate referral program (the "Program") operated by Peggy's Vintage Halloween Art at cozeyhome.net (the "Site"). By joining the Program, you ("Affiliate," "you") agree to all terms below. If you do not agree, do not participate in the Program.
1. Enrollment & Eligibility
- You must have a registered collector account on the Site and be at least 18 years of age.
- Enrollment is free. We reserve the right to accept, decline, suspend, or remove any Affiliate at our sole discretion, at any time, with or without cause.
- One affiliate account per person. Duplicate or fraudulent accounts will be terminated and any accrued earnings forfeited.
2. How the Program Works
- Upon joining, you receive a unique referral link (and optional channel-specific links, such as a Facebook Group link).
- When a visitor clicks your link, a tracking cookie is stored in their browser for 30 days. Attribution is first-touch: the first affiliate link a visitor clicks receives credit.
- If that visitor creates a verified collector account within the cookie window, you earn the current signup reward.
- If a member you referred completes a verified purchase on the Site, you earn the current purchase reward.
- Referrals are credited only after our systems verify them. We may withhold, adjust, or reverse credits for cancelled, refunded, disputed, or fraudulent transactions.
3. Commission Rates
Current rates as of this page load:
- Verified new member signup: $0.50
- Verified purchase by a referred member: $1.00
Rates are subject to change at any time, at our sole discretion, without prior notice. Rate changes apply to referrals credited after the change takes effect; earnings already credited at a prior rate are not retroactively adjusted. The rates displayed on your affiliate dashboard at the time a referral is credited are the rates that apply.
4. Payouts
- Payouts are made exclusively via PayPal to the PayPal email address you provide on your affiliate dashboard. You are responsible for keeping it accurate.
- Payouts are processed approximately every 14 days, for balances that have reached the minimum of $5.00.
- Balances below the minimum roll forward to the next payout cycle.
- PayPal fees, if any, are borne by the recipient. We are not responsible for payments sent to an incorrect PayPal address you provided, or for PayPal account limitations on your end.
- If your account is terminated for violating this Agreement, unpaid balances are forfeited.
5. Permitted Promotion
You may share your affiliate links and our provided banners on your own website, blog, social media profiles, email signature, and in personal recommendations, provided you do so honestly and in compliance with this Agreement.
6. Prohibited Conduct
The following will result in immediate termination and forfeiture of unpaid earnings:
- Spam: unsolicited bulk email, comment spam, repeated unsolicited private messages, or posting your link in communities where it is not permitted — including any Facebook group whose rules prohibit it.
- Self-referrals: using your own link to credit yourself for your own signups or purchases, or those of members of your household.
- Fraud: fake accounts, bots, automated signups, incentivized signups made solely to collect rewards, cookie stuffing, or any artificial inflation of referrals.
- Misrepresentation: claiming to be Peggy's Vintage Halloween Art, implying an employment or official partnership relationship beyond being an independent affiliate, or making false claims about our products.
- Trademark/brand bidding: purchasing search ads on our business name or domain, or registering domains or social accounts confusingly similar to ours.
- Unlawful or inappropriate placement: promoting our links alongside unlawful, hateful, adult, or otherwise objectionable content.
7. Independent Contractor Status
You participate in the Program as an independent party. Nothing in this Agreement creates an employment, agency, partnership, or joint venture relationship. You have no authority to make commitments on our behalf.
8. Taxes
You are solely responsible for any taxes owed on your affiliate earnings. Earnings are reported and paid to you as-is; consult your own tax advisor regarding your obligations.
9. Program Changes & Termination
- We may modify, suspend, or discontinue the Program — in whole or in part — at any time. If the Program is discontinued, verified balances above the payout minimum will be paid out in the next cycle; balances below the minimum may be paid at our discretion.
- You may leave the Program at any time by contacting us. Verified balances above the payout minimum at the time of departure will be paid in the next cycle.
- We may update this Agreement from time to time. Continued participation after an update constitutes acceptance of the revised terms. The "Last updated" date at the top reflects the current version.
10. Limitation of Liability
The Program is provided "as is." To the maximum extent permitted by law, our total liability to you arising out of the Program shall not exceed the total amount of unpaid affiliate earnings credited to your account. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost opportunities, or for tracking failures caused by cleared cookies, browser privacy settings, ad blockers, or circumstances outside our reasonable control.
11. Governing Law
This Agreement is governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in New Jersey.
